These Legal Notices and Terms of Use govern your access to and use of the HomeSwab™ website, mobile application, customer account, products, laboratory-testing services, reports, and related features collectively referred to as the “Services.”

By accessing or using the Services, creating an account, or purchasing a HomeSwab™ product, you agree to these Terms. If you do not agree, please do not use the Services.

About HomeSwab

HomeSwab, LLC (“HomeSwab,” “we,” “us,” or “our”) provides at-home environmental sample-collection kits and facilitates the analysis of submitted samples by qualified third-party laboratories.

HomeSwab is not a property inspection company, healthcare provider, medical laboratory, remediation contractor, or government agency.

Environmental Testing Limitations

HomeSwab results apply only to the sample collected and submitted for laboratory analysis. Results may be affected by where, when, and how the sample was collected, handled, stored, labeled, or shipped.

A laboratory result:

Represents only the submitted sample.
Does not constitute a complete environmental assessment or property inspection.
Does not establish that an entire property is safe, healthy, habitable, or free from environmental concerns.
Does not guarantee that mold, lead, radon, bacteria, or another substance is absent from other areas.
Should not be used as the sole basis for medical, legal, real-estate, remediation, or major financial decisions.

Mold results cannot establish compliance with a federal mold-exposure standard because no federal threshold limits have been established for indoor mold or mold spores.

When conditions are extensive, concealed, recurring, associated with significant water damage, or potentially hazardous, consult an appropriately qualified environmental professional.

Not Medical Advice

HomeSwab products, laboratory reports, educational materials, and artificial-intelligence features are provided for environmental-information purposes only. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition and are not a substitute for advice from a qualified healthcare professional.

If you are experiencing symptoms or believe an immediate health or safety hazard exists, contact an appropriate healthcare provider, emergency service, or qualified environmental professional.

Artificial-Intelligence Features

HomeSwab may provide artificial-intelligence tools that help explain laboratory terminology, organize information, or provide general educational guidance.

AI-generated information may be incomplete or inaccurate and should not replace the official laboratory report or professional judgment. If AI-generated information conflicts with the laboratory report, the laboratory report controls.

Customer Responsibilities

You are responsible for:

Reading and following all collection, labeling, packaging, safety, and shipping instructions.
Providing accurate registration and sample information.
Selecting an appropriate sampling location.
Avoiding cross-contamination.
Submitting samples within any stated time limit.
Using only approved packaging and shipping procedures.
Complying with applicable laws and carrier requirements.

HomeSwab is not responsible for inaccurate, incomplete, delayed, or inconclusive results caused by improper collection, contamination, incorrect labeling, insufficient sample material, shipping damage, or failure to follow instructions.

Accounts and Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to create an account or purchase Services.

You are responsible for maintaining the confidentiality of your login information and for activity conducted through your account. Notify HomeSwab promptly if you believe your account has been accessed without authorization.

Orders, Pricing, and Payment

Prices, product availability, promotions, and service descriptions may change without notice. The price displayed when an order is submitted controls, except in the case of an obvious pricing or technical error.

HomeSwab may refuse or cancel an order when:

A product is unavailable.
Payment cannot be authorized.
Fraud or unauthorized activity is suspected.
An incorrect price or product description was displayed.
The order violates applicable law or these Terms.

If HomeSwab cancels an order after payment has been processed, the applicable amount will be refunded.

Sales Tax

Applicable sales tax will be calculated based on the order, purchaser information, shipping destination, and applicable tax requirements.

Shipping and Delivery

Available shipping destinations will be displayed during checkout. Delivery dates are estimates unless HomeSwab expressly states otherwise.

HomeSwab will make reasonable efforts to ship orders within the timeframe stated at purchase. If an order cannot be shipped within the promised timeframe, HomeSwab will provide notice and any cancellation or refund options required by applicable law.

Carrier delays, weather, incorrect addresses, inaccessible delivery locations, and other circumstances outside HomeSwab’s reasonable control may affect delivery. Nothing in this section limits any non-waivable rights provided by applicable consumer-protection law.

International Orders

If international shipping is offered during checkout, the customer is responsible for applicable customs requirements, import restrictions, duties, taxes, brokerage fees, and return-shipping requirements.

HomeSwab does not guarantee that a product or sample may legally be shipped to or from every country. We may refuse or cancel an international order when shipping, import, export, laboratory, or carrier requirements cannot be satisfied.

Laboratory Processing and Turnaround Times

Laboratory turnaround times are estimates and generally begin after the laboratory receives and accepts the sample—not when the kit is ordered, registered, collected, or mailed.

Processing may be delayed by shipping conditions, holidays, laboratory volume, equipment issues, incomplete registration, improper labeling, damaged packaging, insufficient sample material, or circumstances outside HomeSwab’s reasonable control.

HomeSwab does not guarantee results by a particular date unless that guarantee is expressly stated in writing for the specific order.

Returns and Refunds

Returns, replacements, cancellations, and refunds are governed by the HomeSwab Return and Refund Policy available at [insert Return and Refund Policy link].

Because HomeSwab kits may contain consumable collection materials and include laboratory services, eligibility may depend on whether a kit has been opened, registered, used, activated, shipped to the laboratory, or processed.

Privacy

The Privacy Policy explains what information HomeSwab collects, how it is used, when it may be shared, how it is protected, and what choices may be available to you.

Unless otherwise stated, the website, application, text, graphics, reports, instructions, photographs, videos, software, designs, and other content are owned by or licensed to HomeSwab, LLC and are protected by applicable intellectual-property laws.

You may view, download, or print website materials solely for personal, noncommercial, informational use. You may not reproduce, modify, republish, sell, distribute, or commercially exploit HomeSwab content without prior written permission.

Trademarks

HomeSwab™, its logos, slogans, product names, and related brand elements are trademarks or trade dress belonging to HomeSwab, LLC.

Other names and trademarks appearing through the Services belong to their respective owners. Reference to another company, laboratory, product, or service does not necessarily imply endorsement, sponsorship, affiliation, or approval.

Nothing on the website grants any license or right to use a trademark or other intellectual property except as expressly authorized in writing.

Acceptable Use

You may not:

Use the Services for unlawful, fraudulent, or deceptive purposes.
Interfere with the operation or security of the Services.
Attempt to access another user’s account or restricted systems.
Upload malicious code or harmful content.
Misrepresent, alter, or falsify sample or customer information.
Copy, scrape, reverse-engineer, or commercially exploit the Services except as permitted by law.
Use a laboratory report or HomeSwab content in a misleading or deceptive manner.

Third-Party Services and Links

The Services may rely on or link to third-party laboratories, payment processors, shipping carriers, software providers, and external websites.

HomeSwab does not control every third-party service and is not responsible for its content, availability, security practices, or independent actions. Your use of a third-party service may also be governed by that provider’s terms and policies.

Website Accuracy and Availability

HomeSwab attempts to keep its website and product information accurate and current. However, information may occasionally contain typographical, technical, pricing, or availability errors.

We may correct errors and modify, suspend, or discontinue website content, features, products, or Services at any time, subject to applicable law and existing customer obligations.

Disclaimer of Warranties

To the fullest extent permitted by law, the Services and website content are provided “as is” and “as available.”

HomeSwab disclaims implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement to the extent those warranties may legally be disclaimed.

HomeSwab does not warrant that the website will always be uninterrupted or error-free or that environmental sampling will identify every condition present at a property.

Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded or limited.

Limitation of Liability

To the fullest extent permitted by law, HomeSwab, LLC and its members, employees, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the use of, inability to use, or reliance on the Services.

To the fullest extent permitted by law, HomeSwab’s total liability arising from a product or Service will not exceed the amount paid for the specific product or Service giving rise to the claim.

These limitations do not apply where prohibited by law or to liability that cannot legally be excluded or limited.

Refusal or Termination of Service

HomeSwab may suspend or terminate an account, cancel an order, reject a sample, or refuse service when reasonably necessary to:

Comply with applicable law.
Protect customers, employees, laboratories, carriers, or the public.
Prevent fraud, misuse, threats, harassment, or unsafe conduct.
Enforce these Terms.
Address nonpayment or misuse of the Services.

Any refund associated with a canceled order will be handled in accordance with applicable law and the HomeSwab Return and Refund Policy.

Governing Law

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles, except where another jurisdiction’s consumer-protection laws must apply.

Subject to any non-waivable consumer rights, disputes arising from these Terms or the Services shall be brought in a state or federal court with appropriate jurisdiction in or serving Waukesha County, Wisconsin.

Changes to These Terms

HomeSwab may update these Terms periodically. The updated version will be posted on this page with a revised “Last updated” date.

Changes apply prospectively unless otherwise stated or required by law. Your continued use of the Services after an update constitutes acceptance of the revised Terms.

Severability

If any provision of these Terms is found unenforceable, that provision will be interpreted or limited as necessary to make it enforceable, and the remaining provisions will continue in effect.

Entire Agreement

These Terms, together with any applicable product instructions, order terms, Return and Refund Policy, and Privacy Policy, constitute the agreement between you and HomeSwab regarding the Services.
